Licence means the right to access and use the Product.

Licensee means the purchaser and user of the Product.

Product means Standards and other publications related material and content ordered and purchased through the Intertek Inform in hard copy format or downloaded as electronic PDF files.

SA Licensed Material means Publications published by Standards Australia Limited.

2. Product Availability

2.1. The Product is available via the World Wide Web through the use of a web browser. Documents are provided as hard copy prints or PDF files, viewable through the use of the latest version of Adobe Reader®.

3. Licence Agreement

3.1. By using the Product, the Licensee agrees to be bound by this Licence Agreement for the Product.

3.2. The Licensee is granted a non-exclusive, non-transferrable, non-sublicensable, limited licence to use the Product.

3.3. The Licensee is permitted to use the Product the following extent:

3.3.a. PDF (Personal Use) Format - Purchasers of personal user Licences for the PDF format of the publication may locally install and use the publication on the number of individual computers corresponding to the Quantity specified in the Intertek Inform order. Licensees are permitted to print once for Internal use limited to the Quantity specified in the Intertek Inform order only (excludes electronic pads of forms). Licensees are permitted to store one electronic version of the publication for backup purposes.

In the case of SA Material, the Product is distributed in Single User Electronically Communicated PDF.  The purchaser may access the Product on one device by one authorised user.  The purchaser has the right to print the item twice, with the right to add notes to the Product, with the right to save the item to one device (ie users may save the document to their local machine; if the document is sent to another machine, it will not open), and without the right to copy the whole or any part of the Product (ie copy/cut and paste is not permitted) except to exercise the rights as specifically conferred above.  Users should be aware that the document is watermarked on every page with the buyer name, date of purchase and a notation that reproduction, distribution, and storage or use on a network is prohibited.

In the case of SA Material, the Product is distributed in Multi User PDF.  The purchaser may access the Product on a number of devices specified by Intertek Inform or by the number of authorised users specified by Intertek Inform, with the right to add notes to the item, with the right to print the item twice, with the right to save the item to one device, and without the right to copy the whole or any part of the Product (ie copy/cut and paste is not permitted) except to exercise the rights as specifically conferred above.  Users should be aware that the document is watermarked on every page with the buyer name, date of purchase and a notation that reproduction, distribution, and storage or use on a network is prohibited

3.3.b. Hardcopy Format - Purchasers of personal user Licences for hardcopy formats of the Product are not permitted to make copies of the Product or portions thereof.  Further, only a single authorised user is permitted to access the Product and the purchaser does not have the right to save the Product on any device.

3.4. Intertek Inform will not in any way provide the Licensee with an updating service for the Product. The Licensee agrees that Intertek Inform has no obligation whatsoever to advise you of any amendments or changes to the Product or even as to its withdrawal from publication irrespective of the reason for any such amendment, change or withdrawal.

3.5. It is expressly agreed that the relevant publisher and its licensors are, and will remain, the owners of all intellectual property rights in the Product or is an authorized distributor of the intellectual property. Licensees shall not challenge or call into question the relevant publisher's ownership of Intellectual Property Rights in respect of the Product.

3.6. The Licensee agrees that:
3.6.a. the Product is subject to copyright; it must not remove, alter or obscure any ownership, copyright, trade mark, confidentiality or other marks or legends (including any digital watermark or other digital rights management tool) on or in the Product. Unauthorized copying of the Product and any modification of or merger with other software or documents is expressly forbidden; and
3.6.b. it will protect the security of the Product in its possession and preserve the Product and relevant publisher's intellectual property rights. 

However, in consideration for entering into this licence agreement and agreeing to pay the Licence fees to Intertek Inform, the Licensee may use the Product to obtain information contained in the electronic PDF files for their own Internal use only but shall not otherwise merge, use, modify, copy, adapt, supply, transmit, translate, embed,  send by e-mail, reproduce, rent, lease, sell, sublicense, assign or otherwise exercise any intellectual property rights or do any other thing in relation to, the Product or parts of the Product, or remove any proprietary notice or label appearing on any of the Product. The Product may not be copied or circulated electronically, including by electronic mail, even for Internal use.


3.7. The Licensee shall not modify, adapt, translate, reverse engineer, decompile, disassemble or create derivative works based on the Product.

3.8. The Licensee shall ensure that all of the personal users that have rights to access the Product under this Licence shall exercise that right only for the purposes specified and shall not use the Product for any other purpose.

3.9. For reproduction of the Product or portions of the Product, and for which are outside the circumstances included in this agreement, permission must be sought in writing from Intertek Inform, Copyright Officer at copyright@intertekinform.com

3.10. The Product is Licensed only to the Licensee. Under no circumstances may the Product be transferred by the Licensee to any other party without the prior written consent of Intertek Inform. Under no circumstances is the Licensee permitted to reproduce material from the Product for external use or for use on any other site or group of sites.

3.11. This Licence will terminate automatically and without notice if the Licensee fails to comply with any provision of the Licence. Upon termination the Licensee agrees to destroy all copies of the Product.

3.12. The Licensee acknowledges that no promise, representation, warranty or undertaking (other than any contained in this Agreement) has been given by Intertek Inform or any person or company on its behalf in relation to the profitability of or any other consequences or benefits to be obtained from the use of the Product and the Licensee relies wholly upon his own skill and judgment in deciding to use the Product.
3.13. Intertek Inform shall not be liable to the Licensee or any other person in respect of any loss or damage, however caused which may be suffered or incurred or which may arise directly or indirectly in respect to the Product.

3.14. No warranty is made by any party connected with this Product, express or implied, with regard to the quality, utility or accuracy of the Product and no liability will be accepted for any damage, direct, indirect, special or consequential, arising in any way out of the use of the Product.

3.15. With respect to SA Material, Intertek Inform holds the benefit of these terms on trust for Standards Australia and may enforce these terms on Standards Australia's behalf and for Standards Australia's benefit.

This agreement is governed by and must be construed in accordance with the laws of the State of New South Wales.  The Licensee submits to the exclusive jurisdiction of the courts of the State of New South Wales and the Commonwealth of Australia in respect of all matters arising out of or relating to these terms, their performance or subject matter.
